INSPIRED is committed to ensuring the protection of the privacy of all visitors (“Visitors”) to our websites at inspiredmarketing.co.za and inspiredpublications.co.za (the “Websites”), as well as all persons (“Customers”) who have registered for an account with us (“Account”).

This Privacy Policy (“Policy”) describes the collection, management and disclosure of Personal Data that We Process when providing Our Services (in the capacity of both a Controller, and a Processor, as dictated by the circumstances). By engaging in or using Our Services, You (the Data Subject) acknowledge and signify Your consent to the Processing of Your Personal Data in accordance with this Policy. We may amend this Policy at any time. 1. Definitions
The following expressions shall bear the meanings assigned to them below and cognate expressions shall bear corresponding meanings:
- “Controller” shall mean the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the Processing of Personal Data. Use of the term ‘Controller’ in this Policy is synonymous with the term ‘Responsible Party’;

- “Data Protection Supervisory Authority” shall mean the relevant supervisory authority or regulator responsible for overseeing compliance with the applicable Data Protection Laws;

- “Data Subject/s” shall mean You, being an identified or identifiable natural person. Where You are using or engaging with our Services in South Africa, the term Data Subject shall extend to an identified or identifiable juristic person;

- “Personal Data Breach” shall mean a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, Personal Data transmitted, stored or otherwise Processed;
- “Process/Processed/Processing” shall mean any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
- “Processor” shall mean a natural or legal person, public authority, agency or other body which Processes Personal Data on behalf of the Controller. Use of the term ‘Processor’ in this Policy is synonymous with the term ‘Operator’;
- “Services” shall mean any marketing services that We provide to one or more of our clients; and
- “Third-Party” shall mean any other natural or juristic person that is not You (the Data Subject), or Us.
2. General Provisions
- This policy applies to all Personal Data Processed by Us as a Controller i.e. responsible under the Data Protection Laws for the protection of Your Personal Data.
- Where required by law, We will register with the appropriate Data Protection Supervisory Authority as an organisation that processes Personal Data.
- In certain instances, we Process Personal Data on behalf of a Third-Party - We are not responsible for the privacy policies of such Third-Parties and you are advised to familiarise Yourself with such policies impacting You.
3. Data Protection Principles and Rights
We are committed to Processing Personal Data in accordance with Data Protection Laws that grant You specific Data Protection rights. In accordance with such Data Protection Laws, we ensure that Your Personal Data shall be:
- Processed lawfully, fairly and in a transparent manner in relation to Data Subjects;
- Collected for specified, explicit and legitimate purposes and not further Processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;
- Adequate, relevant and limited to what is necessary in relation to the purposes for which they are Processed;
- Accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that Personal Data that are inaccurate, having regard to the purposes for which they are Processed, are erased or rectified without delay;
- Kept in a form which permits identification of Data Subjects for no longer than is necessary for the purposes for which the Personal Data are Processed; Personal Data may be stored for longer periods insofar as the Personal Data will be Processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the applicable Data Protection Laws in order to safeguard the rights and freedoms of Data Subjects; and
- Processed in a manner that ensures appropriate security of the Personal Data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.
4. Lawful, Fair And Transparent Processing
- To ensure Our processing of Personal Data is lawful, fair and transparent, We will maintain a Data Processing Register.
- Where You invoke any of Your rights in relation to Your Personal Data, any such valid requests made to Ourselves shall be dealt with in a timely manner and We shall retain a record of such request. Our Data Processing Register.
5. Lawful Purposes
- All Personal Data Processed by Us are Processed on a lawful basis, for lawful purposes.
- Where consent is relied upon as a lawful basis for Processing of Personal Data, You will have the option to revoke Your consent or otherwise object to the Processing of Your Personal Data. 6. Data Minimisation
- We shall ensure that Personal Data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are Processed.
- Where Personal Data is not relevant or no longer required, the Personal Data will either be deleted or Processed in aggregated form, in which We case We will de-identify Your Personal Data.
7. Accuracy
- When sharing any Personal Data with Us, You undertake to ensure that any such Personal Data is accurate and up to date.
- Where necessary for the lawful basis on which Personal Data is Processed, measures shall be put in place to ensure that Personal Data is kept up to date and is accurate.
8. Archiving / Removal
- To ensure that Personal Data is kept for no longer than necessary, We will put in place a retention policy for each area in which Personal Data is Processed. The retention policy shall consider what Personal Data should/must be retained, for how long, and why.
9. Security
- We will ensure that Personal Data is stored securely.
- Access to Personal Data will be limited to Our personnel who need access, and such Personnel will be subject to confidentiality and non-disclosure obligations. Appropriate security will be in place to avoid unauthorised sharing of Personal Data.
- When Personal Data is deleted, or anonymised, this will be done safely in such a way that the Personal Data is either irrecoverable or incapable of re-identification.
- Appropriate back-up and disaster recovery solutions will be in place.
10. Breach
- In the event of a breach of security leading to a Personal Data Breach, We shall promptly assess the risk to the rights and freedoms of Data Subjects and if appropriate, report this breach to the relevant Data Protection Supervisory Authority, or to You.
- Where We act as a Processor to a Third Party responsible for the protection of Your Personal Data, We will notify the relevant Third Party without undue delay, after becoming aware of a Personal Data Breach involving Your Personal Data.
